NOTICE OF SUBSTITUTE TRUSTEE'S SALE 0 Hermitage Road, Goochland, Virginia 23103 and 275 Lucille Road, Manakin-Sabot, Virginia 23103 Tax Map Reference Nos.: 58-35-0-2-A; 58-35-0-2-B Pursuant to the terms of that certain Amended, Restated and Consolidated Deed of Trust dated July 27, 2017 and recorded in the Clerk's Office for the Circuit Court for Goochland County, Virginia on August 2, 2017 as Instrument No. 170002414 (the "Deed of Trust"), the real property described in the Deed of Trust commonly known as 0 Hermitage Road, Goochland, Virginia and 275 Lucille Road, Manakin-Sabot, Virginia, and all improvements related thereto (collectively, the "Property"), as set forth below and as more specifically described in the Deed of Trust, to which reference is hereby made, will be offered for sale at public auction: ALL those two certain lots, pieces or parcels of land with all improvements thereon and appurtenances thereto belonging, lying and being in Dover District, Goochland County, Virginia, and being designated as Parcel 2A containing 6.26 acres and Parcel 2B containing 5.11 acres as shown on a plat of survey made by Kenneth M. Hart & Associates, Tommy James Barlow Land Surveying, P.C., dated March 1, 2004, a copy of which was recorded on March 19, 2004, in the Clerk's Office, Circuit Court, Goochland County, Virginia, in Plat Cabinet D-60, reference to which is made for a more particular description. BEING the same land assigned to Susanne Haas by Decree entered in the Clerk's Office, Circuit Court of Goochland County, Virginia, on March 12, 2004, in the chancery cause of Marcilla A. Nichols, Plaintiff, vs. Susanne A. Hass, et al, Defendants, Case No,. 03-54, a copy of which was recorded on March 19, 2004, as Instrument No. 040001432, wherein it was adjudged, ordered and decreed, that Hass was conveyed two parcels, containing 6.26 acres and 5.11 acres, described above. The sale will take place at 11:00 a.m. on January 26, 2022 at the Goochland County Circuit Court, 2938 River Road West, Goochland, Virginia 23063. Terms: The purchase price in the form of immediately available funds will be due and payable on the closing date. A deposit in the form of immediately available funds in the amount of 10% of the bid amount may be required of the successful bidder at the time of sale. The successful bidder will be required to close within thirty (30) days of the date of sale. Time will be of the essence as to the closing date and the payment of the purchase price. All loss or damage to the Property from the time of sale and before settlement shall be at the risk of the successful bidder. The Property will be sold "AS IS" and conveyed by Special Warranty Deed, subject to all rights, reservations, leases, covenants, conditions, easements and restrictions, as they may lawfully affect the Property. Neither the Substitute Trustee nor the holder of the note secured by the Deed of Trust will deliver physical possession of the Property to the successful bidder. The successful bidder at the sale will be required to pay all closing costs, including the Grantor's recording tax. Real estate taxes will be pro-rated as of the foreclosure sale date.
