SUBSTITUTE TRUSTEE'S SALE 10907 Walton Lake Road Disputanta, VA 23842 In execution of the Deed of Trust dated October 3, 2018, and recorded on April 26, 2019, as Instrument No. 190001132 in the Clerk's Office, Circuit Court, Prince George County, Virginia, John J. Trexler, the appointed Substitute Trustee, will offer for sale at public auction on the steps of the Prince George Circuit Court, 6601 Courts Drive, Prince George, Virginia 23875, on December 8, 2020 at 11:00 a.m., the property more par¬ticularly described in the aforementioned Deed of Trust, located at the property address listed below and briefly identified as follows: All that certain lot of land, situate in Rives Magisterial District, Prince George County, Virginia, on the east side of and adjacent to State Highway Route No. 649, containing one and one-fourth (1.25) acres, more or less, and bounded and described as follows, to-wit: Beginning at a point on the east boundary of said Highway, at the southwest corner of a lot of land heretofore conveyed by the parties of the first part to Thomas C. Wall by deed of correction dated August 27, 1959, and recorded in the clerk's office of said County in Deed Book 168, page 275, running thence in a straight line along the south boundary of the said Thomas C. Wall lot and an extension thereof 262 1/2 feet to a point; thence in a southwesterly direction, parallel with the east boundary of said highway 210 feet to a point; running thence in a northwesterly direction, parallel with the north boundary of the property hereby conveyed 262 1/2 feet, more or less, to the east boundary of the said Highway, running thence in a northeasterly direction along the east boundary of said Highway 210 feet to the point of beginning. The property will be sold "AS IS" WITHOUT REPRESENTATION OR WARRANTY OF ANY KIND AND SUBJECT TO conditions, covenants, restric¬tions, reservations, easements, rights of way, and all other matters of record taking priority over the Deed of Trust, if any, as might be listed in this notice or may be announced at sale. Additionally, the property will be sold subject to a certain deed of trust from James R. Jordan, Jr., Grantor, to Molly H. Sammler, Esq., Trustee, dated November 15, 2016, and recorded November 16, 2016, in the Circuit Court, Prince George County, Virginia, and having Instrument No. 160003407, securing the sum of $82,500.00 plus interest. TERMS OF SALE: CASH: A deposit of $2,000 or 10% of the sale price, whichever is less, by cash or certified check will be required at time of sale, except for the party secured by the Deed of Trust. Risk of loss is on the purchaser from date and time of auction. Balance of the purchase price must be paid by cashier's check within 14 days from sale date. Except for Virginia Grantor's tax, all settlement costs and expenses are purchaser's responsibility. Taxes are pro-rated to the date of sale. Purchaser is responsible for obtaining possession of the property. If purchaser defaults, the deposit may be forfeited and property resold at the risk and cost of the defaulting purchaser who shall be liable for any deficiency in the purchase price and all costs, expenses, and attor¬ney's fees, of both sales. If Trustee does not convey title for any reason, purchaser's sole remedy is return of deposit without interest. This sale is subject to post-sale audit of the status of the loan secured by the Deed of Trust including but not limited to determining whether prior to sale a forbearance, repayment, or other agreement was entered into, the loan was reinstated or paid off, or whether the property became subject to an automatic stay under the U.S. Bankruptcy Code prior to the sale; in any such event this sale shall be null and void and purchaser's sole remedy shall be return of deposit without interest.
